The pharmaceutical giant Pfizer Inc. has agreed to pay $1.2 billion to settle 11 drug product liability lawsuits alleging that it sold and promoted Viagra, a drug used to treat erectile dysfunction (ED) and benign prostatic hyperplasia (BPH). The settlement comes on the heels of a long-term investigation of pharmaceutical company Pfizer Inc. by a U. S. federal judge and a New York State Superior of Appeals for Multidistrict Litigation in September of last year.
Pfizer has sued to prevent the company from distributing its Viagra prescription drug, Cialis, that it claims violated the Federal Food, Drug and Cosmetic Act (FDCA). The suit alleged that Pfizer’s marketing efforts to sell the drug, which has long been touted as a “potato," were motivated by a desire to maximize profits.
The complaint alleged that Pfizer’s marketing practices in the United States were directed at consumers by brand-name manufacturers who sold their drugs without the approval of the FDA and that their promotion of the drug violated federal regulations. Pfizer, for example, marketed Cialis in the United States as a “prostate enlargement product” that was approved by the FDA and then promoted as “Viagra.”
The lawsuit was filed in the U. District Court for the Eastern District of New York. Pfizer said it would pay the civil settlement amount of $500,000 to settle the lawsuits.
The lawsuit alleges that the company’s marketing of Cialis were a “commission” for “promotion” by pharmaceutical companies. The complaint also alleged that Pfizer’s promotion of Viagra, a prescription medicine for erectile dysfunction, violated the FDCA.
The company did not respond to a request for comment. The lawsuit has resulted in the court having to decide the case.
The U. District Court for the Eastern District of New York recently granted Pfizer’s motion to intervene after the complaint was filed. The case was heard by U. District Judge David P.ichever court where the case is decided.
